These Terms and Conditions (“Terms”) govern your use of The Raj Ayurveda Health Center website and your purchase, reservation, or use of accommodations, consultations, Panchakarma programs, Ayurvedic treatments, massage and bodywork services, spa services, educational programs, products, and other services offered by The Raj Ayurveda Health Center (“The Raj,” “we,” “us,” or “our”).
By using our website, making a reservation, submitting payment, or participating in services at The Raj, you acknowledge that you have read and agree to these Terms and any additional policies, disclosures, consents, or health forms applicable to your particular program or service.
The Raj provides Ayurvedic wellness programs, consultations, bodywork, massage, spa services, educational services, accommodations, meals, and related services.
Information provided on our website, in emails, educational materials, lectures, social media, or other general communications is provided for informational and educational purposes and is not intended as individualized medical advice, diagnosis, or treatment.
Individualized recommendations may be provided by appropriately qualified practitioners within their professional scope of practice.
The Raj is not an emergency medical facility. If you are experiencing a medical emergency, call 911 or seek appropriate emergency medical care.
Participation in a program at The Raj should not be used as a substitute for medical care you need from your physician or other licensed healthcare provider. You should not discontinue or modify prescribed medication or medical treatment except in consultation with the healthcare professional responsible for that treatment.
Every person responds differently to wellness programs, treatments, dietary changes, bodywork, rest, meditation, and other services.
The Raj does not guarantee any particular medical, physical, psychological, therapeutic, cosmetic, detoxification, weight-related, or other outcome from its programs or services.
Guest testimonials and individual experiences describe the experiences of particular guests and do not guarantee that another guest will experience the same results.
This provision is particularly important because federal advertising law requires objective health claims to be truthful, non-misleading, and appropriately substantiated; testimonials by themselves are not substantiation for a health claim. Federal Trade Commission
Certain programs and treatments, including Panchakarma, require completion of The Raj’s Health Questionnaire and may require review by The Raj’s clinical or wellness team.
You agree to provide complete, current, and accurate information regarding your health and any information reasonably requested to evaluate your participation, including, as applicable:
You are responsible for informing The Raj if information supplied in your Health Questionnaire changes before or during your stay.
Submitting a reservation or deposit does not constitute medical or clinical clearance for treatment.
The Raj reserves the right, in its reasonable professional judgment and subject to applicable law, to modify, postpone, restrict, discontinue, or decline a treatment or program when it determines that the service may not be appropriate for a guest or cannot reasonably be provided.
Where The Raj’s stated booking policy provides that a deposit will be refunded because its clinical review determines The Raj is unable to provide treatment, that policy will apply.
The effectiveness and safety of individualized recommendations depend in part upon the accuracy of the information you provide.
You acknowledge that withholding or providing inaccurate information concerning medications, diagnoses, pregnancy, allergies, recent procedures, injuries, physical limitations, or other material health information may affect The Raj’s ability to evaluate or provide appropriate services.
You agree to promptly tell a practitioner or staff member if you experience pain, dizziness, nausea, weakness, unusual discomfort, an allergic reaction, or another unexpected symptom during a treatment or program.
Panchakarma is an individualized Ayurvedic program and may include different services, dietary recommendations, body treatments, rest, routines, herbs or other products, educational recommendations, and at-home preparation depending upon the individual and program selected.
Not every treatment or component is appropriate for every guest.
Your program may therefore differ from another guest’s program or from examples described on our website or in marketing materials.
The Raj may modify treatment schedules, practitioners, products, techniques, meals, activities, or other program components when reasonably necessary for health, safety, operational, or individualized-care reasons.
Massage, bodywork, topical applications, hydrotherapy, and similar services involve physical contact with the body.
Guests should communicate immediately regarding pressure, temperature, positioning, draping, sensitivity, pain, discomfort, or any other concern.
You may ask that a treatment be adjusted or stopped at any time.
Nothing in these Terms eliminates any rights or protections provided by applicable professional licensing or healthcare laws.
Iowa expressly regulates massage therapy and defines it to include certain bodywork, hydrotherapy, superficial hot and cold applications, topical applications, and manipulation of muscle and connective tissue. Iowa General Assembly
Certain treatments or programs may require a separate informed-consent form.
Before participating, guests may be informed of material risks, contraindications, alternatives, and other information relevant to the particular service.
These Terms do not replace treatment-specific informed consent.
That distinction is important. I would not try to make the website Terms alone serve as The Raj’s medical/treatment waiver.
By voluntarily participating in services at The Raj, you acknowledge that wellness programs, physical activity, dietary changes, massage, bodywork, heat treatments, topical products, herbal products, yoga, walking, and other activities may involve inherent or reasonably foreseeable risks, including temporary soreness, fatigue, gastrointestinal changes, skin sensitivity, dizziness, discomfort, falls, allergic or sensitivity reactions, or other unexpected responses.
You agree to communicate relevant health information and follow reasonable safety instructions provided by The Raj.
I would have Iowa counsel specifically draft the final release-of-liability language rather than inserting an aggressive “release us from all negligence” clause here. Overreaching exculpatory language can create enforceability problems, and no Terms page should suggest that a guest has waived rights that cannot lawfully be waived.
Unless specifically provided by an appropriately licensed professional acting within their scope of practice, The Raj does not prescribe, discontinue, or alter prescription medication.
Guests remain responsible for bringing and appropriately managing their medications and medical devices.
If medical evaluation, hospitalization, emergency transportation, pharmacy services, diagnostic testing, or other outside care is required, those services may be provided by independent third parties and may result in separate charges to the guest.
If The Raj reasonably believes that emergency medical assistance is necessary and you are unable to direct your own care, you authorize The Raj to contact emergency services and provide reasonably necessary information to emergency responders.
You remain responsible for charges imposed by ambulance providers, hospitals, physicians, pharmacies, or other independent healthcare providers, subject to applicable law and insurance coverage.
A reservation is not confirmed until The Raj has received the required deposit or payment and issued confirmation.
Prices, deposits, payment schedules, inclusions, and other booking terms communicated to you at the time of reservation form part of your agreement with The Raj.
You are responsible for reviewing your reservation confirmation and promptly notifying The Raj of any error.
The cancellation, rescheduling, deposit, credit, and refund policy disclosed to you in connection with your reservation applies to your booking.
Unless otherwise expressly stated in writing, deposits are non-refundable.
For programs requiring health review, if The Raj’s clinical team determines from the required health information that The Raj is unable to provide the contemplated treatment, the applicable health-review refund exception communicated at booking will apply.
No employee’s oral statement modifies a written cancellation or refund policy unless The Raj confirms the modification in writing.
This is one section I want to synchronize word-for-word with Cindy’s actual current cancellation policy before you publish it. Iowa’s Attorney General specifically recommends that service providers and consumers put scope, price, and cancellation/refund terms in writing. Iowa Attorney General
Circumstances including practitioner availability, weather, illness, maintenance, supply availability, safety considerations, government requirements, or other events may occasionally require The Raj to modify schedules, treatments, rooms, practitioners, activities, menus, or other aspects of a stay.
The Raj will make reasonable efforts to provide a substantially comparable experience where practicable.
Any legally required refund or other remedy remains unaffected.
Guests are responsible for safeguarding their personal belongings.
To the fullest extent permitted by applicable law, The Raj is not responsible for loss, theft, or damage to personal property except to the extent responsibility cannot lawfully be excluded.
Guests should not bring unnecessary valuables to the property.
Guests must behave in a manner that respects the safety, privacy, dignity, and wellbeing of other guests and staff.
The Raj may refuse or discontinue services or require a guest to leave the property for threatening, abusive, discriminatory, sexually inappropriate, dangerous, illegal, severely disruptive, or other conduct that materially interferes with the safety or wellbeing of guests or staff.
Any refund in such circumstances will be determined under the applicable booking policy and law.
The Raj may decline or discontinue treatments when a guest appears intoxicated, impaired, or otherwise unable to participate safely.
Illegal drugs and unlawful conduct are prohibited on The Raj property.
The Raj serves vegetarian meals and will make reasonable efforts to accommodate disclosed dietary needs and allergies when possible.
Guests with serious or potentially life-threatening food allergies must notify The Raj before arrival and should discuss whether their needs can safely be accommodated.
The Raj cannot guarantee that food prepared in a shared kitchen environment will be completely free from every allergen or trace exposure.
Products, herbs, oils, foods, cosmetics, supplements, or other items offered or recommended by The Raj may contain ingredients capable of causing allergies, sensitivities, medication interactions, or other individual reactions.
Guests should disclose known allergies and medications and ask their physician, pharmacist, or other qualified healthcare professional about potential interactions when appropriate.
Statements regarding traditional Ayurvedic uses should not be understood as guarantees that a product will diagnose, treat, cure, or prevent a disease unless such a claim is legally authorized and appropriately substantiated.
The FTC applies its health-claim substantiation requirements to health-related marketing and notes that traditional-use claims must be carefully framed so consumers are not misled about scientific evidence. Federal Trade Commission
Personal and health information submitted to The Raj will be handled in accordance with The Raj’s applicable privacy practices and Privacy Policy.
Health information should be collected, accessed, used, disclosed, retained, and protected only as permitted by applicable law and The Raj’s internal privacy and security procedures.
Important: I would create a separate Privacy Policy / Health Information Notice rather than trying to handle HIPAA and state privacy requirements in these Terms.
By providing your email address or other electronic contact information in connection with a reservation or inquiry, you consent to receiving communications reasonably necessary to respond to your inquiry, administer your reservation, conduct required health-review and pre-arrival processes, and provide information relating to your stay.
Marketing communications are subject to applicable law and any available unsubscribe or consent requirements.
Consent to receive marketing communications is not a condition of receiving treatment unless legally permitted and expressly stated.
The Raj will not treat acceptance of these Terms as blanket permission to use a guest’s photograph, video, likeness, medical story, or testimonial for advertising.
Where The Raj wishes to use identifiable guest content for promotional purposes, a separate written media/testimonial authorization should be obtained.
I strongly recommend this separation.
The Raj makes reasonable efforts to maintain accurate website information. Programs, schedules, practitioners, availability, prices, amenities, and other details may change.
Nothing on the website creates a guarantee regarding availability or a particular treatment, practitioner, room, result, or experience unless expressly included in the guest’s written reservation agreement.
Unless otherwise indicated, website text, graphics, photographs, logos, videos, educational materials, program materials, and other content are owned by or licensed to The Raj and may not be reproduced, distributed, modified, or commercially exploited without permission except as permitted by law.
The Raj may provide links or access to services operated by independent third parties, including transportation providers, payment processors, healthcare providers, websites, or other businesses.
Those third parties may have their own terms and privacy practices and are responsible for the services they independently provide.
This section should receive specific Iowa-attorney review before publication.
To the fullest extent permitted by applicable law, The Raj will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website or services where such damages may lawfully be limited.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
I deliberately would not write “The Raj shall never be liable for injury, illness, negligence, or death.” That sounds protective but can be legally counterproductive.
Except where applicable law requires otherwise, these Terms and disputes arising from services performed at The Raj will be governed by the laws of the State of Iowa, without regard to conflict-of-law principles.
The fact that guests come from other states does not mean we can simply declare that their home-state consumer protections disappear. This is why I would include the phrase “except where applicable law requires otherwise.”
Unless prohibited by applicable law, the parties agree to make a good-faith effort to resolve a dispute directly before initiating litigation.
Any legal action concerning these Terms or services provided at The Raj that may lawfully be subject to a contractual venue provision shall be brought in an appropriate state or federal court having jurisdiction in Iowa.
I would not add mandatory arbitration or a class-action waiver casually. If Candace wants those protections, an Iowa attorney should make a deliberate decision about them and draft the provision accordingly.
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate, and the remaining provisions will remain in effect.
A failure by The Raj to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or of the right to enforce it in the future.
The Raj may update these Terms from time to time.
The version applicable to a particular reservation will be the version presented or otherwise incorporated into the agreement when the reservation is made, except where a subsequent change is required by law or expressly agreed to by the guest.
